Can an HOA Prohibit You From Going Solar?
According to California’s Civil Code, “anything that prohibits or restricts the installation or use of a solar energy system is void and unenforceable.” So, your HOA cannot prohibit you from installing a solar panel system, but they are allowed to have reasonable restrictions. These restrictions are defined as anything “that does not significantly increase the price of the system or significantly decrease its efficiency or specified performance.”
What Does This Mean?
In other words, your HOA’s rules can’t require you to modify your solar energy system in a way that hinders its performance. It must be able to do its job as efficiently as possible. Lawmakers amended The Solar Rights Act in 2014 to define exactly how much “significantly” means. It says no solar installation should go above $1,000 over the cost of the installation, and should not decrease its efficiency by more than 10%.
